Abstract

The novel coronavirus (COVID-19 or SARS-CoV-2) pandemic has resulted in an increase in the use of and expansion of federal protections in the United States and highlighted the importance of consumer health protections provided. A review of recent literature was conducted to identify major changes to consumer health protections for mental health. This selected review describes consumer health protections for seeking mental health treatment using telehealth under legislation such as the Health Insurance Portability and Accountability Act (HIPAA), the Health Information Technology for Economic and Clinical Health (HITECH) Act, and the Affordable Care Act (ACA). Despite these protections, the use of telehealth for mental health treatment raises concerns about patient privacy, security, and ethics.
